CANCELLATION POLICIES

 

Groups Conditions:

MASTER ACCOUNTS:
Client is responsible for providing the Hotel with written instructions at least 30 days prior to group arrival outlining:

a) Names of persons authorized to sign charges to the Master Accounts
b) List of all charges Client wants posted to Master Accounts
c) Charges for which individual participants will be responsible

All Master and individual accounts must be paid in full prior to group departure unless other arrangements are made in advance of group arrival.

INDIVIDUAL ACCOUNTS:
Separate individual folios will be established for all guests to cover all incidental charges to their rooms not covered by the master folio. Guests before departure from hotel must settle individual folios.

CANCELLATION POLICY OF ENTIRE GROUP:
· 366 days or more, prior to scheduled group arrival date, no cancellation Liability will be assessed.
· 365-181 days: Complete cancellation will result in a One-night charge per person reserved.
· 180-91 days: Complete cancellation will result in a two-night charge per person reserved.
· 90 days prior to group arrival date: Complete cancellation will result in Total charge for the entire stay.
“Client" reserves the right of cancellation without liability if the group cannot meet because of significant physical changes in the hotel caused by new construction or extensive renovation, fire damage, change of ownership of "Hotel" or labor strikes.
In the event the "Hotel" is successful in reselling canceled rooms, no liability charges will be assessed for those rooms.

ROOM ATTRITION POLICY: (for reduction of rooms)
· 366 days or more, prior to scheduled group arrival date, no room reduction liability will be assessed.
· 365-181 days: 30% of room block established at 365 days may be canceled without liability. Any rooms canceled in excess of 20 % are subject to one night charge.
· 180-120 days: 30% of the total room block base established at 180 days may be canceled without liability. Any rooms canceled in excess of 30 % are subject to one night charge
· 119-91 days: 15% of the total room block base established at 119 days may be canceled without liability. Any rooms canceled in excess of 15 % are subject to one night charge
· 90-30 days: 15% of the room block base established at 90 days may be canceled without liability. Any rooms canceled in excess of 15% are subject to a two nights charge.
· 29-8 days: Any rooms canceled are subject to a three nights charge plus any applicable taxes.
· Rooms canceled 7 days prior to group arrival date, and No Shows will be charged for the entire dates of reservation.
In the event the "Hotel" is successful in reselling canceled rooms, no liability charges will be assessed for those rooms.

CONSTRUCTION AND REMODELING:
The Hotel will provide notice in writing of any construction or remodeling to be performed in the Hotel, which might interfere in the operation of this group. The Hotel will be responsible to provide alternate sleeping rooms or function space if unable to fulfill its obligation due to such construction. If acceptable alternate space cannot be provided, Client shall have the right to cancel this group without liability.
INSURANCE: The "Hotel" shall carry liability, fire, burglary, and other insurance in such dollar amounts as necessary to protect itself against claims arising from any activities conducted on "Hotel" property during the operation of this group program.

LIMITATION OF LIABILITY:
The fulfillment of this agreement by either party is subject to acts of God, war, government regulation, disaster, Hurricane, Flood, Influential Terrorist attacks, strikes, civil disorder, and curtailment of required transportation, or other emergencies making it inadvisable, illegal, or impossible to fulfill this agreement. It is provided that this agreement may be terminated for any one or more of such reasons by written notice from one party to the other, without penalty.

INDEMNIFICATION AND HOLD HARMLESS
The Hotel and the Group each agree to defend, indemnify and hold harmless the other party from and against all claims, actions or causes of action, liabilities, including attorneys’ fees, and costs arising from the defense of any claim, action, cause of action or liabilities arising out of or resulting from any act taken or committed by the Hotel on the one hand, or the Group on the other hand, pursuant to the performance or failure to perform each party’s obligations, including the negligence of each party hereunder. The Hotel and the Group each agree to defend, indemnify and hold harmless the other party for any claim, action, cause of action and liabilities which may be asserted by third parties arising out of the performance or failure to perform each party’s obligations pursuant to this contract, including the negligence of each party hereunder, except for the willful misconduct or gross negligence of the other party

ACCEPTANCE
This document cannot be modified without the approval and signature of both parties. Signed in agreement of the terms and conditions.
